Terms of Service
1. Acceptance
By accessing or using HouseIQ (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. What HouseIQ is
HouseIQ is an informational tool that compiles automated property dossiers for addresses in Boston and surrounding municipalities in the Commonwealth of Massachusetts, from public records and other data sources. It produces estimates, scores, flags, and narrative summaries to help you orient yourself before doing your own due diligence. It is not a substitute for professional advice or for the official records of any government authority. Coverage is limited to Massachusetts, and how much of a dossier can be assembled varies by address: the underlying public datasets differ from one municipality to the next, and some are published by the City of Boston alone.
3. No warranty; accuracy
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. Public records and third-party data may be incomplete, outdated, or inaccurate, and our automated estimates may be wrong. We do not warrant that the Service will be uninterrupted, error-free, or fit for any particular purpose.
4. Not professional advice
HouseIQ does not provide legal, appraisal, inspection, engineering, title, financial, insurance, tax, or investment advice, and nothing on the Service is a recommendation to buy, sell, lease, finance, or develop any property. Always verify independently with the appropriate licensed professionals and the relevant city departments before relying on any information.
5. Permitting and feasibility
Feasibility notes are not zoning determinations, code rulings, or permit assurances. Only the City of Boston and other authorities having jurisdiction can decide zoning, permitting, and code matters.
6. Fair housing
HouseIQ does not recommend neighborhoods for or against any person or protected class, and nothing on the Service is a statement about who should or should not live in any location. Risk signals describe property and public-record conditions, not the desirability of any neighborhood or its residents. HouseIQ supports Equal Housing Opportunity.
7. Not a consumer report
HouseIQ reports on a PROPERTY, not on any person. The Service is not a consumer reporting agency, and its dossiers are not consumer reports or investigative consumer reports under the federal Fair Credit Reporting Act (15 U.S.C. §1681 et seq.) or any state analogue. You may not use the Service, in whole or in part, as a factor in establishing any person's eligibility for tenancy, employment, credit, insurance, or any other purpose covered by the FCRA, and you may not use it to screen or investigate an individual. We do not verify the identity of, or collect information about, occupants for those purposes.
8. Acceptable use
You agree not to:
- scrape, crawl, or bulk-extract data from the Service;
- resell, redistribute, or commercially exploit the Service or its output without our written permission;
- reverse engineer, interfere with, or attempt to gain unauthorized access to the Service; or
- use the Service, or anything it produces, to screen, investigate, or make an eligibility decision about any individual (see §7); or
- use the Service for any unlawful purpose or in violation of fair-housing, consumer-protection, or other applicable law.
9. Intellectual property
The Service, its design, and original content are owned by HouseIQ and its licensors. Underlying public-record data remains subject to the terms of its source. We grant you a limited, revocable, non-exclusive license to use the Service for your personal, non-commercial use.
10. Limitation of liability
To the maximum extent permitted by law, HouseIQ and its operators will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss arising from your reliance on the Service or any decision you make based on it. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim, or USD 100 if you paid nothing.
11. Changes
We may update these Terms from time to time. Material changes take effect when we post the updated Terms with a new effective date. Your continued use of the Service after a change constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Massachusetts.
